These Terms of Use ("Terms") are a contract between you and Nariman Abu Baker (trading as "Luma", "we", "us", "our"), the provider of the Luma service (the "Service"). By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, please stop using the Service.
Luma is a generative AI assistant available on the web and iOS. Free accounts include limited daily use (chat, images, files, voice minutes). Luma Pro is a paid monthly subscription that unlocks unlimited use and additional features. You must be of legal age in your country, or have the authority to bind your organization, to use the Service.
You are responsible for keeping your login credentials confidential, for all activity under your account, and for keeping your account information accurate and up to date.
You agree not to misuse the Service. In particular, you must not:
You retain ownership of the content and prompts you submit. You grant us a limited, worldwide, non-exclusive license to host, process, and transmit that content solely to operate and provide the Service to you. You are responsible for your prompts, for how you use outputs, for verifying accuracy before relying on them, and for ensuring you have the rights to any input content.
AI outputs may be inaccurate, incomplete, or offensive. Outputs are not a substitute for professional medical, legal, financial, or other regulated advice, and should be independently verified before being relied upon.
We may remove or restrict content, refuse or filter outputs, and suspend accounts that repeatedly or seriously violate these Terms. If you believe content infringes your rights, contact us at h.abubaker2020@gmail.com with details; repeat infringers will have their accounts terminated.
The Service, including its software, models, interface, and branding, is owned by Nariman Abu Baker and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
Luma Pro subscriptions are sold and billed exclusively through the Apple App Store. Payment, billing, taxes, renewals, and cancellations are handled by Apple under Apple's Media Services Terms. Subscriptions renew automatically until cancelled. You can cancel at any time from your Apple ID subscription settings on your iPhone or iPad; cancellation stops future renewals. We work to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. Features may change, and we may perform maintenance from time to time.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to us for the Service in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, for fraud, death, or personal injury caused by negligence).
You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service in breach of these Terms, or your violation of law or third-party rights.
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we will delete or anonymise your account data in accordance with our Privacy Notice.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date below and, where appropriate, by an in-product notice. Continued use of the Service after changes take effect means you accept the updated Terms.
You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Neither party is liable for delays or failures in performance caused by events beyond their reasonable control.
These Terms are governed by the laws of the country in which the seller resides, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory local law requires otherwise.
